These Terms and Conditions (the “Terms”) govern access to and use of the website, the launcher, the “Imprisoned” video game, the forum, the blog and any related services (together, the “Service”), owned by TRIPLE J SOFTWARE DEVELOPMENT, S.L. (“TRIPLE J”, “we”, “us”).

2. Acceptance
Use of the Service implies full and unreserved acceptance of these Terms. If you do not agree, do not use the Service.
3. Access and registration
- Access to certain features requires the creation of a user account.
- You must be at least 14 years old to register. Between 14 and 18, you need authorisation from your parents or guardians.
- The information you provide on registration must be truthful and kept up to date.
- You are responsible for safeguarding your credentials and for all activity carried out from your account. Notify us immediately of any unauthorised access.
4. Status of the Service
- Imprisoned is in development (including, where applicable, pre-alpha, alpha and beta phases). The Service may contain bugs, be unstable, change or be temporarily or permanently discontinued.
- We may reset worlds, characters, progression or inventory when necessary for technical, balance or security reasons.
- Nothing in these Terms guarantees uninterrupted availability of the Service or indefinite retention of game data.
5. Software and launcher licence
- We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the launcher and the game client for the sole purpose of accessing the Service in accordance with these Terms.
- You may not: (a) reverse engineer, decompile or disassemble the software, except as permitted by law; (b) modify, distribute, sublicense, sell or rent the software; (c) circumvent security or anti-cheat measures; (d) extract, copy or reuse game assets outside the Service.
- The launcher may automatically download and install updates to keep the client’s integrity.
6. User conduct
By using the Service you agree not to:
- Infringe applicable law, third-party rights or public order.
- Harass, threaten, impersonate, defame, post sexual content involving minors, hate speech or content inciting violence.
- Cheat, use bots, exploits, unauthorised software, client modifications or any technique that disrupts normal game operation.
- Trade accounts, characters or in-game items outside official mechanisms.
- Send unsolicited advertising, spam or phishing.
- Collect other users’ data without their consent.
- Overload the infrastructure through denial-of-service attacks or unauthorised load testing.
7. User content
- You are solely responsible for the content you publish (messages, names, images, etc.).
- By publishing content on the Service, you grant us a free, worldwide, non-exclusive licence for the legally required term to host, reproduce, display and communicate it publicly for the purpose of operating and promoting the Service.
- We may remove or moderate content that breaches these Terms or applicable law.
8. Purchases and virtual goods (when available)
- The Service may offer the purchase of virtual goods, subscriptions or other products.
- Virtual goods are a limited licence to use them within the Service. They are not legal tender, have no real-world value and are not redeemable or transferable outside the Service.
- The right of withdrawal under consumer law does not apply to digital content whose performance has begun with your prior and express consent, in accordance with art. 103.m) of Royal Legislative Decree 1/2007.
9. Intellectual and industrial property
- All rights over the Service, including code, art, music, text, trademarks and distinctive signs, belong to TRIPLE J or its licensors.
- No rights are granted other than the limited use licence described in these Terms.
10. Suspension and termination
- We may suspend or terminate your account, in whole or in part, if you breach these Terms, the Service rules, applicable law, or if you put the security of the Service or other users at risk.
- You may close your account at any time from the settings or by writing to legal@playimprisoned.com. Termination does not entitle you to a refund of consumed virtual goods.
11. Limitation of liability
- The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we do not warrant the absence of errors, uninterrupted availability or fitness for a particular purpose.
- We are not liable for indirect damages, loss of profit, loss of data or loss of opportunity arising from the use or inability to use the Service, except in cases of wilful misconduct or gross negligence.
- Nothing in these Terms limits liability for personal injury, fraud or any other liability that the law does not allow to be excluded.
12. Third-party links and services
The Service may contain links to third-party services, governed by their own terms. We do not control nor are we responsible for those services.
13. Changes
We may amend these Terms to adapt them to legal, technical or Service changes. We will publish the current version with its date. If the changes are material, we will notify you with reasonable notice.
14. Governing law and jurisdiction
- These Terms are governed by Spanish law.
- For any dispute, the parties submit to the courts of the consumer’s domicile, when acting as such. For users who are not consumers, the parties submit to the courts of Murcia (Spain), expressly waiving any other jurisdiction.
15. Online dispute resolution
Pursuant to Regulation (EU) 524/2013, consumers may use the European Commission’s online dispute resolution platform: ec.europa.eu/consumers/odr.
